Description: Representação vetorial em formato de polígiono dasáreas de Terras Indígenas em Porto Alegre/RS, conforme a base da FUNAI (2021). A Terra Indígena é a terra tradicionalmente ocupada por índios, definidas como sendo: aquelas por eles habitadas em caráter permanente, as utilizadas para suas atividades produtivas, as imprescindíveis à preservação dos recursos ambientais necessários a seu bem-estar e as necessárias a sua reprodução física e cultural, sendo seus usos, costumes e tradições. Esta definição é proveniente do Parágrafo 1º do artigo 231 da Constituição Federal. Segundo o inciso XI do artigo 20 da Constituição, as terras indígenas constituem bens da União, que, pelo §4º do artigo 231, as terras indígenas são inalienáveis e indisponíveis e os direitos sobre elas imprescritíveis. Embora os índios detenham a posse permanente e o usufruto exclusivo das riquezas do solo, dos rios e dos lagos existentes em suas terras, conforme o parágrafo 2º do Artigo 231 da Constituição, elas constituem patrimônio da União.E, como bens públicos de uso especial, as terras indígenas, além de inalienáveis e indisponíveis, não podem ser objeto de utilização de qualquer espécie por outros que não os próprios indios.
